Wie die französische Tageszeitung Le Parisien meldet, unterstützt die Gewerkschaft CFDT 28 Castmember, die sich an das Schlichtungsgericht in Meaux gewandt haben wegen Streitigkeiten zur Bezahlung für die Zeit, die sie benötigen, um von den Garderoben zu Ihren Arbeitsplätzen zu gelangen. Castmember, die On-Stage tätig sind und ein Kostüm tragen, aber nicht zu dem Character, Show und Parade Department gehören, werden für je 7 1/2 Minuten vor und nach Ihrer Schicht bezahlt, um in den Garderoben in bzw. aus dem Kostüm zu wechseln. Die Zeit die sie benötigen, um im Kostüm von den Garderoben zu ihrem eigentliche Arbeitsort und später wieder zurückzugelangen, wird jedoch nicht vergütet. Ausgehend von einer Entscheidung des Berufungsgerichts vom 13. Jul 2004 bezüglich der Mitarbeiter eines Geschäftes in Rhone, handelt es sich bei dieser Zeit aber um zu vergütende effektive Arbeitszeit, da der Arbeitgeber während des Transfers bereits Aufträge erteilen kann. Dabei basiert die Entscheidung auf einer 2000 gesetzlich neu aufgenommenen Definition der effektiven Arbeitszeit.
Sollten die 28 CMs erfolgreich sein, wie die Gewerkschaft erwartet, wären ungefähr 2.000 bis 3.000 CMs betroffen, die täglich ca. 2 Euro mehr erhalten müssen - so jedenfalls Le Parisien in dem auf der Website von CFDT EuroDisney veröffentlichten Artikel. Entsprechend würden die Arbeitskosten für die Gruppe steigen. Zudem würde die Gewerkschaft, so erneut Le Parisien, wohl die entsprechenden Zahlungen rückwirkend bis 2000, als das neue Gesetz erlassen wurde, für alle Betroffenen fordern. Dadurch könnte eine einmalige Belastung von 2 bis 3 Millionen Euro die Bilanz der Gruppe weiter belasten.
Es ist alelrdings daraufhin zu weisen, dass die aktuelle Entwicklung nicht unerwartet kommt. Ursprünglich hatte CFDT EuroDisney eine Anpassung der Regelungen in der Gruppe schon am 20. November 2004 gefordert. Während der jährlichen Gehaltsverhandlungen gab daraufhin EuroDisney S.C.A. am 20. Januar 2005 bekannt, dieses Thema gemeinsam mit der Problematik der 35-Stunden-Woche in gesonderten Verhandlungen zu thematisieren. Diese wurden nun aber bereits zweimal durch EuroDisney S.C.A. verschoben, so dass sie wohl erst im Herbst tatsächlich eingeleitet werden, und die Gewerkschaft beschlossen hat, weitere Schritte einzuleiten.

As the French daily Le Parisien reported today the union CFDT supports 28 castmembers who have appealed to the arbitration board in Meaux regarding the issue of payment for the transfer time from the changing rooms backstage to their work locations and back. Castmembers working on-stage in costume who are not in the character, show or parade department are paid only for 7 minutes and 30 seconds before and after work to change from their street cloths into their costumes - the time needed to get from the changing rooms to their actual work locations on-stage and later back again is not clocked as part of their working time. But based on a decision of the courts of appeals from July 13th, 2004 in the case of shop workes in Rhone this time should be counted as effective working time as the company could already give them orders during the transfer time. The decision is based on a new defintion of effective working time introduced in 2000 by law.
If the 28 Cms succeed with their appeal, as the union expects, 2,000 to 3,000 CMs would be affected who should receive each about 2 Euro extra per day according to the article of Le Parisien reprinted on the website of CFDT EuroDisney further increasing the labor costs. In addition according to Le Parisien the union would most likely request that all CMs receive this payment retroactive since 2000, as in that year the term of "effective working time", on which the decision in question depeneds, was defined accordingly by law. This could result in a one-time-payment between 2 and 6 million Euro that would further hamper the group's results.
It needs to be pointed out though, that the current actions are not unexpected. Originaly CFDT EuroDisney wanted to find a solution for the dispute outside the courts and demanded according policy changes as early as November 20th, 2004. During the annual negotations about wage increases on January 20th, 2005 EuroDisney S.C.A. then announced that due to the huge implications the topic would be combined with the negotiations about the 35 hour workweek, which had been uncoupled from the regular negotiations. As planned negotiations now have been reschuled by EuroDisney S.C.A. twice and are not expected to start before autumn, the union decided to press the cause on its own again.
